While online lotteries are not as popular as online casinos, they have proven successful. Six states have authorized online lottery sales, and more are likely to follow. Although the Wire Act was not enacted to prohibit online lottery sales, the Department of Justice revised its opinion in December 2018. That opinion limited online lottery sites to those within the state’s borders.

After the DOJ’s revision, a number of states are looking into the prospect of launching their own online lotteries. New Hampshire is suing the Department of Justice over its decision. It argues that the Wire Act does not apply to lotteries, since they are not a form of sports betting. But the Department of Justice ruled against New Hampshire’s request.

Even so, the decision has provided the state of New Hampshire with a stronger stance on online lottery. New Jersey, Maine, and Massachusetts are in the process of legalizing their own online lotteries. Despite the federal government’s decision, other states have been able to establish their own online lotteries.
